Terms of Service

These Terms of Service ("Terms") govern the use of byanalytics (https://byanalytics.co), provided by Rafa Marco, 334******, Calderón de la Barca, 42 · 03201 Elche (Alicante), Spain ("we"). By creating an account you accept these Terms on behalf of yourself or the organisation you represent.
1. The service
byanalytics is a web analytics service that combines a cookie-less tracker with data from third-party services you choose to connect. Features and limits depend on your plan, as described on the pricing page.
2. Accounts
You must provide accurate information, keep your credentials secure and enable two-factor authentication where possible. You are responsible for activity in your workspaces, including that of members you invite.
3. Plans, trial and payment
- The Free plan is free of charge within its limits.
- New workspaces receive a 14-day Pro trial without payment details. At the end of the trial the workspace returns to the Free plan unless a paid plan is chosen.
- Paid plans are billed in advance, monthly or yearly, through Stripe. Prices exclude applicable taxes.
- Plan changes take effect immediately with proration. Cancellation takes effect at the end of the current period.
- If a payment fails we notify the owner by email and retry the charge over the following days; the plan stays active meanwhile. If it still cannot be collected, the subscription is cancelled and the workspace returns to the Free plan.
- When a workspace moves to a lower plan nothing is deleted at that moment. Sites beyond the new plan's limit are paused: they stop recording visits and being monitored, their existing data stays available, and they resume when the plan covers them again. The shorter data retention of the lower plan applies 14 days after the change.
- Consumers in the European Union may withdraw from a first paid subscription within 14 days of the purchase and receive a full refund by writing to our contact form. This does not apply to customers acting for a business or profession.
4. Usage limits
If a workspace exceeds its monthly event quota, we notify the owner at 80% and 100% and continue to accept events up to a 10% grace margin. Beyond that, new events may be dropped until the next month or an upgrade. Existing data is never deleted because of a limit.
5. Your data
You keep all rights to the data you collect. You grant us the rights necessary to host and process it to provide the service. We process visitor data as your processor under the Data Processing Agreement, which forms part of these Terms. You are responsible for informing your visitors and for having a legal basis for the measurement.
6. Acceptable use
You must comply with our Acceptable Use Policy. We may suspend workspaces that breach it.
7. Third-party services
Connectors rely on third-party APIs (Google, Microsoft, Cloudflare and others) under their own terms. We are not responsible for their availability, changes or quotas.
8. Availability
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be announced where possible.
9. Liability
To the extent permitted by law, our total liability for any claim is limited to the amounts paid by you in the 12 months before the event giving rise to the claim. We are not liable for indirect damages or loss of profits. Nothing in these Terms limits liability that cannot be limited by law, or the rights of consumers.
10. Termination
You may delete your workspace at any time. We may terminate accounts for material breach. After termination, data is deleted from the live systems immediately and from backup copies within 30 days, except where retention is required by law (for example invoices).
11. Changes
We may update these Terms. Material changes will be notified by email at least 30 days in advance.
12. Law and jurisdiction
These Terms are governed by the laws of Spain. Unless mandatory consumer law provides otherwise, disputes are submitted to the courts of the city of our registered address.
